PRIVACY POLICY AND TERMS OF USE OF THE APP
Important note
Your health is important to us! We therefore ask you to read the following section, which explains that the device is not a medical device and what this means.
This device helps you to better understand the effects of your diet and lifestyle on your body. It analyzes the amount of carotenoids in your body. Carotenoids in your blood and tissues are a good indicator of the presence of antioxidants. A high level of carotenoids is also a sign that you are eating enough fruit and vegetables.
This app should only be used by healthy people, as it cannot provide suitable recommendations for health-critical situations or users who are ill. We expressly point out that the app and device are not medical products and may therefore only be used by healthy people. Certain diseases can falsify the measurement result, especially if the diseases cause skin discoloration. Errors or defects in the device or the software can lead to incorrect readings. Therefore, never rely solely on the displayed values and always adhere to the manufacturer's instructions, e.g. when dosing food supplements.

Users who do not feel healthy should consult a doctor and should not rely on the results or recommendations of this app to find a cure. Users with health problems should consult their doctor to determine whether the use of the app and device and the interpretation of the measurement results is advisable in view of the health problems.
This app helps healthy people to achieve a diet rich in antioxidants and vitamins and to monitor their nutritional situation in the long term. Numerous renowned organizations recommend the consumption of a sufficient amount of fruit and vegetables for a good diet. A good diet can help improve your well-being and provide your body with optimal nutrients. (our tip: search the internet for “recommended vegetable intake” or “carotenoid benefits” for more information).

PRIVACY POLICY
biozoom services GmbH, Ziegelstraße 17 in D-34121 Kassel ("biozoom" or "we") takes data protection very seriously and wants to ensure that your privacy is protected and that you are informed about the use of your data. In this privacy policy, we therefore explain how and for what purposes we use your data.
1. data protection zones
At biozoom, data protection is divided into three data protection zones.

1.1 Green data protection zone (under the responsibility of biozoom)
If you have purchased your scanner via biozoom and use the biozoom app, you are initially in the green data protection zone. In this zone, your data generated with the measurement will neither be passed on to third parties nor used for your own advertising purposes. The data is only processed to calculate the measurement result and to improve the measurement quality and is stored anonymously on a biozoom server. Personal data is typically not collected with the app. Biozoom is therefore not in a position to assign generated data or measurement processes to specific persons. It is possible to assign the data to the scanner used. This is done via the serial number of the scanner, which is transmitted to the biozoom server together with the measured raw data.

Important note: If you are nevertheless asked for information, this will be saved with the measurement data. Do not enter any information that you do not wish to be saved. The amount of data requested varies depending on the country and sales partner.
From version 0.5.31 (2024/07), the app informs you which server data is to be sent to and requests your consent the first time data is sent to an external server. This allows you to check where your data is being sent to. If the server is operated by an operator other than Biozoom, please contact the server operator to find out which data protection guidelines apply there. The consent is saved. You can reset it by reinstalling the app.
The personal data that biozoom receives when you purchase or send the scanner is neither linked to your measurement data nor stored in a shared database. This ensures that measurement results cannot be linked to you personally, even in the event of a successful hacker attack.
In most cases, the app will not display the result directly, but the result will be displayed via our partners' website. The main advantage of this is that the explanation of the measurement results can be maintained by our partners in the respective language. Suggestions on how to improve your measured value can also be provided in a more targeted manner.

Important note: Consent to leave the green zone can be given permanently so that users are not prompted to agree to data protection conditions for every measurement. If you are using an app where someone else may have permanently accepted the data protection conditions of the yellow zone (see next chapter), please use the option offered in the main menu and remove the tick in the “Skip data protection confirmation” checkbox.
If you use the app to measure people other than yourself, by using the app you undertake to treat these people correctly in accordance with the data protection conditions applicable in your country. Furthermore, you undertake to comply with the data protection requirements set out here and to inform persons who use the app of Biozoom's data protection procedures (see also the chapter Terms of Use). Please contact Biozoom if you require the display of notices by the app (note: the display of additional notices is possible, but may incur additional costs).

1.2 Yellow data protection zone (outside the responsibility of Biozoom)
Biozoom's partners may provide you with offers and services via the app or via websites accessible with the app. This applies in particular to the display and explanation of the measurement result. For this purpose, the app provides these services with the measurement results and the data entered by you.
The respective partner, not Biozoom, is responsible for data protection on the part of our partner. In some countries, however, Biozoom also provides this service itself. In any case, the data protection guidelines of the service provider apply. We refer to this area as the yellow zone.

However, it is very important to us that our users can clearly understand how their data is protected. The app therefore informs you which partner or website your measurement results are being shared with and asks for your consent. This request usually occurs after the measurement. If you confirm that you agree, you then enter the yellow data protection zone. From this point on, the service provider or partner/client is responsible for complying with the applicable data protection regulations.
The reason for this is that Biozoom distributes its products worldwide, and data protection laws differ from country to country. Due to these differences, Biozoom cannot tell you how the third party is allowed to use your data or how they actually use it. Relevant information can only be found in the third party's own data protection policy. However, the Biozoom app ensures that measurement results are only transmitted to the third party and displayed to you after you have given your consent to share the data with the partner at least once.

You can choose to save your consent so that you are not asked again with each measurement. By saving it, you agree to inform third parties who are measured using the app about the consent you have given regarding the yellow zone before conducting a measurement. To relieve you of this responsibility, it is possible to deactivate the saving of consent (please contact Biozoom for this).
​
1.3 Red Data Protection Zone
In the red data protection zone, personal data is also collected via the app. Typical use cases include, for example, medical studies in which the scanner is used, and data is collected to identify a participant or additional data (such as measurement data or questionnaires) is recorded.

For such use cases, a separate data protection agreement is made with the user, which governs how the data may be used.
​
2. Measurements and Measurement Procedures
​
2.1 When you take measurements using the biozoom scanner, the raw data is initially encrypted by the scanner and then transferred via Wi-Fi or USB to the biozoom app on your smartphone or tablet. The smartphone/tablet forwards it via the internet using a secure connection (https) to a biozoom server for evaluation. The connection remains active until the encrypted measurement result is sent back to the app via the same secure (https) connection. On the biozoom server, the data is stored anonymously together with the data you entered. By agreeing to the privacy policy and the terms of use (see below), you consent to this storage.
​
2.2 To prevent overloads during the calculation of the measurement result and to reduce global susceptibility to internet interruptions or outages, biozoom operates multiple servers (currently in Germany, Japan, and Canada).
​
2.3 There are several ways the measurement results can be displayed on your smartphone/tablet: directly in the app (green data protection zone), as a web view within the app (yellow data protection zone), or outside the app via a browser as a website (yellow data protection zone). Your consent is obtained before data is displayed on a website.
​
2.4 The biozoom app can be configured to collect additional data before or after a measurement. As part of a study, this may include subject or patient numbers as well as personal data collected, for example, through the completion of a questionnaire. Due to the associated transition to the red data protection zone, the user must consent to the collection of this data in advance.
​
2.5 Special personal data such as the actual name of the user, their address, or telephone number are not usually requested by biozoom, so even in the event of a hacker attack, the connection between the measurement result and the person cannot fall into the hands of third parties.
​
3. Use of Data to Improve biozoom Services
​
The data stored on biozoom servers (green data protection zone) is used to continuously improve the user-friendliness and quality of the scanners and biozoom services. This includes, for example, checking and improving compatibility between the app, scanner, and end device (smartphone/tablet). When you install the biozoom app and take measurements, biozoom may record information such as the operating system version of your device, installation issues, driver information, type, number, and timing of operations and measurements performed.
​
Anonymized measurement data is also used to develop optimizations of the evaluation algorithms. These may aim, for example, to automatically detect faulty measurements or to measure additional biomarkers. Furthermore, the data is used for statistical purposes, such as determining the distribution of measurement results for certain regions or groups of people.
​
Data is generally not passed on to other organizations unless you explicitly agree to the data transfer (yellow zone). In such cases, only the measurement result, its accuracy, and the information you entered are passed on.
​
4. Access, Correction, and Deletion of Data
​
4.1 You have the right at any time to obtain free information about your personal data and, if applicable, request biozoom to delete all your data, provided biozoom is not legally obligated to retain some or all of the data. In this case, we will delete your data from all active servers. However, deletion from backup media is not technically possible. Please note that we do not store all data and may typically refuse to release data if it cannot be confirmed that the requesting person is the one who was measured.
​
4.2 Since your personal data is usually not stored under your real name, as it is not requested, access or deletion cannot be performed using your name. If you have entered personal data using a user ID or subject number, you must, for data protection reasons, prove to biozoom that this ID or subject number can be clearly assigned to you. If you own a scanner, you can request the deletion of all data linked to the serial number of your scanner. In this case, you must also prove your identity and ownership of the scanner, typically by sending the scanner to Biozoom.

4.3 Access to or deletion of your data stored by biozoom must be requested in writing. Please send a corresponding request to:

4.4 If you transfer/sell the biozoom scanner to a third party, the rights and options for data deletion also transfer to the new owner.

TERMS OF USE
​
1. Purpose and Form of the Terms of Use
1.1 The biozoom Terms of Use govern the use of the biozoom scanner, the biozoom software (biozoom app, biozoom scanner firmware), and biozoom services for measuring biomarkers in human skin, as well as the use of additional features (e.g. personal advice) provided by biozoom. The purchase of the biozoom scanner is not subject to these Terms of Use.
​
1.2 These Terms of Use come into effect between you and biozoom services GmbH, Ziegelstraße 17 in D-34121 Kassel ("biozoom") when you install the app. If you do not agree to the Terms of Use, you may not use the biozoom software or biozoom services. Ownership of the scanner remains unaffected.
​
1.3 If you are entering into these Terms of Use on behalf of another person, e.g. your employer, you must ensure that you are authorized to do so on their behalf.
​
2. Biozoom Software
2.1 By agreeing to the Terms of Use, you are granted the right to install the biozoom app on end devices and to use it together with the firmware of the biozoom scanner and the purchased services for measuring the respective biomarker. The usage rights granted to you are non-transferable and may not be sublicensed. Corresponding rights are granted for updates (see Section 7) once they are installed on your end device.
​
2.2 You are not permitted to use the biozoom software beyond the rights granted to you. In particular, you are not allowed to:

use the biozoom app in a virtual operating environment or without a biozoom scanner; the demo mode of the app is an exception and can be used without a biozoom scanner;
-
virtualize or use individual features of the biozoom software separately;
-
rent or lease the biozoom software without a scanner;
-
bypass or disable technical security measures in the biozoom software; or
-
reverse engineer, decompile, or disassemble the biozoom software. Your statutory rights to decompile and disassemble the software under Section 69e of the German Copyright Act (UrhG) remain unaffected.
​
2.3 The biozoom software may contain third-party programs (including open-source software). The license terms of the respective third parties or open-source licenses take precedence over these Terms of Use for such programs. The open-source licenses used by biozoom are listed below.
​
2.4 If you use the biozoom software to measure other people besides yourself, you are obligated to behave in a way that respects the rights and interests of those individuals. In particular, you must ensure that:
a) Data protection requirements are met. Specifically, you must ensure that neither biozoom nor yourself violate data protection laws. You must also ensure that the measured persons are informed about what happens to their data. Explicit consent from the measured person must be obtained. You can do this, for example, by not allowing the user to enter data and not permanently storing consent for data transfer to external providers, but instead obtaining it anew from each user.
b) No false or misleading claims are made. In particular, you must not give the impression that the biozoom scanner is a certified medical device if you are using a model without medical certification. The biozoom scanner is a device users can use, for example, to check their diet. However, it must not be used to diagnose illnesses. If measurement values indicate a potential illness, further verification by a doctor or invasive procedure (e.g. blood test) is required.
​
3. Requirements for Use
3.1 To use the biozoom app or biozoom services on a smartphone or tablet, Android 8 or higher or iOS 8 or higher is required. Data exchange between the biozoom scanner and the smartphone is carried out via Wi-Fi or USB cable connection between the scanner and smartphone/tablet. Please note that cable connections are not possible with Apple devices, as Apple phones and tablets currently do not support this.
​
3.2 Using the biozoom services requires an internet connection on your end device (this may also be via mobile network). Access to and use of these networks (including any incurred charges) are subject to the terms of your mobile or internet provider. The costs for data transmission when using the biozoom services are your responsibility. We recommend an unlimited data plan for using the biozoom services. If your internet or mobile connection is restricted, interrupted, or too slow, you may not be able to use the biozoom services.
​
3.3 You are solely responsible for the procurement and operation of the systems, components, and telecommunication services required for using the biozoom services via the internet or mobile network. All associated services are not part of the biozoom services.
​
4. Use of the biozoom Services
4.1 The data you measure with a biozoom scanner is linked to the serial number of that scanner. Storage of the measured data may be offered by biozoom or the local distribution partner as a service. Please contact the respective service provider and read the section on the yellow data protection zone.
​
4.2 If you use the biozoom services to measure third parties with the scanner, the third party must have agreed to the privacy policy and terms of use. In particular, you must comply with the conditions described in 2.4. You are required to protect third-party measurement results (including historical data) from unauthorized access and may only publish them with the consent of the affected person. Where allowed by applicable national legislation, anonymized publication of measurement results is permitted.
​
4.3 Some features may require the creation of password-protected user accounts or an activation code. You are responsible for keeping access codes secure and protecting this information from unauthorized access. Do not share access codes with unauthorized persons.
​
4.5 The biozoom services are not storage services. You are responsible for regularly backing up the measurement data and history obtained through your biozoom software so that the information remains available to you even if you no longer use the biozoom scanner or services.
​
4.6 You have the right to request the deletion of all data and histories linked to your scanner number from the biozoom server at any time. For more information, see the privacy policy (Section 4: Access, Correction, and Deletion of Data).
​
4.7 biozoom reserves the right to delete data measured by a biozoom scanner. Biozoom also reserves the right to block the use of a scanner if, for example, there has been a violation of these terms or if outstanding payments for purchase or service fees are due.
​
4.8 biozoom aims to provide you with uninterrupted access to the biozoom services. However, as this is technically only partially feasible, biozoom is not obligated to provide uninterrupted services. biozoom is not liable for any damages resulting from service interruptions.
​
4.9 biozoom accepts no liability for the accuracy of measurement results obtained via the biozoom services. For instance, illness-related factors, medication, data transmission errors, or optical factors such as dirty skin, tattoos, skin type, climate, or lighting conditions can lead to inaccurate values.
​
4.10 The biozoom scanner and services are not medical devices. Measurements must only be performed on healthy skin, and no medical treatments should be derived from the measurement results. You should always aim for a balanced diet and not regulate your nutrition based solely on the results from the biozoom scanner. An unbalanced diet can lead to inaccurate results. Always consider the advice of professionals such as doctors or nutritionists.
​
4.11 You are responsible for ensuring that the use of the scanner and biozoom software complies with local laws and regulations. biozoom cannot be held responsible for violations of local regulations.
​
5. Fees for Using biozoom Services
5.1 The fees for using the biozoom services can be charged in various ways. Usage may be included in the purchase price of the scanner and allow either unlimited or time-limited use of a service (e.g. 2 years). There may also be usage models in which the customer must acquire usage rights separately — for example, by purchasing the right to perform a limited number of measurements each month or to conduct unlimited measurements within a defined period (e.g. one year). Extending the usage period, increasing the quota, or acquiring rights for another service is usually possible (note: if the device has exceeded a certain age, recalibration may be required — in such a case, contact biozoom). Current offers for using the services can be found on the website www.mybiozoom.com. The same applies to information on purchasing usage rights, available payment options, and conditions.
Once you download the biozoom app from the App Store/Play Store and the scanner is connected to your display device (smartphone, tablet, etc.), you can begin using the services you’ve purchased. This also applies if you acquire additional usage rights later. After the purchased usage period expires, the respective service will no longer be available to you. At that point, you must either stop using the service or purchase an extension.
​
5.2 By purchasing the rights to use a service, you agree that biozoom may transmit the measurement data collected using the biozoom scanner, along with all associated information, to a biozoom server via the app in encrypted form, evaluate it there, and store it anonymously on the biozoom server.
Detailed information can be found in the privacy policy.
​
5.3 If you have rented a biozoom scanner (e.g. together with an end device) for using certain biozoom services, no additional costs will be incurred for using the scanner and services beyond the rental fee.
By signing the rental agreement, you agree to the provision described in 5.2.
​
6. SHOP Terms of Use
6.1 The biozoom services may offer access to a shop or a link to a shop where you can search for, download, purchase, rate, and review medical content or nutritional advice, supplements, health and cosmetic products. Some of the related features may cause errors, may not function as expected, or may not yet be available.
​
6.2 The terms of use of the respective shop operator or the website provider apply to the use of shops or links to shops.
​
7. Updates
7.1 biozoom may provide you with free bug fixes and improvements to the biozoom software (collectively referred to as “updates”). These updates are typically installed automatically on your end device (smartphone/tablet), or you will be prompted to manually install them when necessary. This feature may not be disabled.
​
7.2 The core functions of the biozoom software and biozoom services remain unaffected by updates.
​
7.3 You hereby agree to receive automatic updates without additional notification and authorize biozoom to download and install updates on your behalf. You agree to only accept updates to the biozoom software from biozoom or other sources authorized by biozoom.
​
8. Liability
8.1 biozoom is fully liable under the warranties it has assumed and in accordance with the Product Liability Act (ProdHaftG) in cases of intent, gross negligence, and for injury to life, body, or health.
​
8.2 In deviation from the provisions of Section 8.1, biozoom is only liable for slight negligence in cases of breach of cardinal obligations. Cardinal obligations are those obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely.
In such cases, biozoom’s liability is limited to the foreseeable damage typical of the contract at the time of conclusion.

8.3 The provisions in Sections 8.1–8.2 also apply to claims for reimbursement of expenses under Section 284 BGB (German Civil Code). They also apply to biozoom’s legal representatives, employees, and agents.
​
9. Applicable Law and Jurisdiction
9.1 The Terms of Use and all rights and obligations arising from or in connection with them are governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
​
9.2 The place of jurisdiction for all disputes arising from the use of the scanner, the biozoom services, the biozoom app, and the biozoom firmware is Kassel.
​
10. Final Provisions
10.1 Amendments and supplements to the Terms of Use must be made in writing to be effective. This also applies to changes to written requests. "Writing" within the meaning of these Terms of Use means a signed declaration sent by post in original form to the other party. Text form, such as a declaration sent by email, does not meet this requirement.
​
10.2 biozoom reserves the right to amend and/or supplement these Terms of Use in whole or in part to reflect technical or commercial changes. If biozoom intends to change the Terms of Use, it will inform you of the intended changes and/or additions. This may be done, for example, via a link displayed in the app through which you can view the new Terms of Use. Once you agree to them, you may continue using the app.

10.3 You are not entitled to assign or transfer your rights and obligations under these Terms of Use.
​
10.4 biozoom is entitled to subcontract any of its services. All subcontractors engaged will be contractually obligated by biozoom to comply with the applicable privacy policy.
​
10.5 biozoom is entitled to transfer this contract to a third party.
